If you want to be taken serious in business and give an ultimatum you have to stick with it or any future ultimatums wont be taken serious. Bayern gave an ultimatum and now they should pull from this deal. If Spurs think it have a higher worth for them to have Kane for 1 season than having 100 millions then it´s on them. In a season he can walk away with no income for Spurs. Spurs screwed up and Bayern will manage a season before getting Kane.
